Need to apply for a divorce?

When it comes to divorce, it often isn’t clear that the actual divorce process is separate to property and parenting matters.

Sure, they can interlink — for example, you generally only have 12 months after your divorce is granted to go to Court in relation to property matters, but you can file for divorce either before or after your property or parenting matters are sorted.

Applying for a divorce is one of the simpler applications in the Federal Circuit and Family Court of Australia. If there are no children under the age of 18 from the marriage, the Court doesn’t even require the Applicant to be present. If there are minor children, it’s still usually a very straightforward hearing.

Sometime divorce isn’t so straightforward.  We can help with that too if you’re:

Separated under the one roof?

The law requires that you and your partner are separated for at least twelve months before applying for a divorce. If some of that period has been spent separated, but living under the one roof, you will need to file:

  • an Affidavit from you setting out the living arrangements and history of separation; and
  • an Affidavit from another person who knew you were separated but living under the one roof.

Short marriage?

The law requires that you attend mandatory marriage counselling if you seek a divorce after being married for less than two years. If you don’t attend counselling, you will need to file an Affidavit explaining why.
